The Legal Verdict:“The land transferred by landowners in favor of the Authority under the Land Pooling Scheme vis-a-vis the transfer of developed reconstituted plots back to the landowners vests absolute, clean, and marketable title free of all encumbrances. The allottees and their transferees have complete statutory authority to sell, gift, exchange, or mortgage the property to commercial financial institutions.”

5 Foundational Legal Protections Under Indian Law

Primacy of Special Law (APCRDA Act over TP Act 1882)

Special statutory legislation overrides General Property Law. Surrender vests clean unencumbered title in APCRDA, and LPOC vests absolute marketable title in the farmer.

APCRDA Act 2014 (Section 52 & 54)

The Authority is statutorily mandated to guarantee return of reconstituted freehold plots. Reconstituted plot vests unconditionally with the landowner.

RFCTLARR Act 2013 (Sections 96, 107 & 108)

LPOC legally equates to an award in lieu of compensation. Under Section 96, all allotments are completely exempt from stamp duty and registration fees.

Section 51 of APCRDA Act & Family Transfer

Exempts surrender deeds and LPOC from registration fees, plus provides a one-time conversion and stamp duty exemption on first transfer to spouse or children.

Income Tax Act 1961 (Section 10(37A))

Capital Gains tax is 100% exempt for farmers transferring their pooled land or original LPOC returnable plots.

Commercial Bank Mortgageability

Nationalized and scheduled private commercial banks (SBI, HDFC, ICICI, etc.) accept LPOC and registered conveyance deeds as valid primary collateral for home and commercial construction loans.

6-Step Clean Title Conveyance Flow

1. Farmer submits Form 9.3 voluntary surrender agreement.

2. APCRDA registers Form 9.14 Development Agreement.

3. Village Layout finalized, peg-marked with color-coded DGPS markers, and digitally lotteried.

4. Authority issues official Land Pooling Ownership Certificate (LPOC) with QR code.

5. Regular Sub-Registrar Office executes Title Deed with 4 distinct reference maps (zero registration fees).

6. Encumbrance Certificate (EC) reflects clean, marketable, individual freehold title.

Commercial Bank Mortgages & Loan Eligibility

Nationalized and scheduled private commercial banks—including State Bank of India (SBI), HDFC Bank, ICICI Bank, and Punjab National Bank (PNB)—regularly sanction housing loans, plot purchase loans, and commercial construction loans against APCRDA Land Pooling Ownership Certificates (LPOC).

Statutory Title Guarantee

Section 54 guarantees that the Authority bears responsibility for clearing any prior encumbrances.

Full Right to Alienate

LPOC holders possess unconditional rights to sell, lease, transfer, or mortgage the land without prior NOC.

Equitable Mortgage Creation

Banks create equitable mortgages by deposit of the original registered LPOC with the Sub-Registrar.

Primacy of Special Statutory Law & RFCTLARR Act Equivalency

⚖️ Special Law Overrides General Law

Under settled Indian jurisprudence, Special Legislation always supersedes General Law (the APCRDA Act prevails over the Transfer of Property Act, 1882). Title surrender to the Authority vests clean unencumbered ownership, and reconstitution back to the farmer creates an unassailable freehold title.

📜 RFCTLARR Act 2013 Award Equivalency

The LPOC is recognized as an "award passed in lieu of compensation" under Sections 107 and 108 of the RFCTLARR Act, 2013. Consequently, under Section 96 of the RFCTLARR Act, initial plot allotments are completely exempt from stamp duty and registration fees.

Landowners receive a 100% one-time exemption from land conversion fees (agricultural to non-agricultural) and stamp duty on first-time development or transfer of the reconstituted plot to immediate family members (spouse or children).

Statutory Nature of Contracts & Article 226 Public Law Enforceability

Statutory Contract (Public Law Instrument) • Article 226 Constitution of India (Writ Jurisdiction)

Unlike traditional civil development agreements (which are governed strictly by private contract law), the contract executed under Form-V (or Form 9.14 / Form-IV) is legally deemed a Statutory Contract. Because the APCRDA is an "instrumentality of the State," any breach of contract by the Authority directly empowers the landowner to invoke public law remedies by filing a Writ Petition under Article 226 in the High Court.

Rule 16: Dual-Tier Appellate Mechanism with Strict 30-Day Windows

If any party is aggrieved by an eligibility or entitlement order passed by the Competent Authority (Deputy Collector), Rule 16 guarantees an expeditious statutory appeal ladder:

First Appellate Authority⏱️ Within 30 Days

Commissioner, APCRDA

Any person aggrieved by any decision or order of the Competent Authority for Land Pooling (Deputy Collector) may file a statutory appeal before the Commissioner.

Second Appellate Authority (State Government)⏱️ Within 30 Days

Government of Andhra Pradesh (MA&UD Department)

Any person aggrieved by an order passed by the Commissioner in appeal may prefer a second appeal before the State Government whose decision shall be final.
